QUAY Social Media Giveaway – Official Rules
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED OR RESTRICTED BY LAW.
By participating in the QUAY Back to School Giveaway (the “Promotion”), you agree to be bound by these Official Rules.
1. Sponsor
The Promotion is sponsored and administered by Quay Eyewear, Inc., 465 California Street, San Francisco, CA 94104 (“QUAY” or the “Sponsor”), in collaboration with the following participating brands (collectively, the “Participating Brands”):
· Courting Tennis
· Milk Shake
· Groa Beauty
· SUNPLUS
· Glamnetic
· First Day
· Tilt Beauty
· James Read Tan
· Fiji Water
The Participating Brands are contributing products to the Promotion as prize providers only. QUAY is solely responsible for the administration of the Promotion, including determining eligibility, conducting the random drawing, selecting and notifying potential winners, and awarding the prizes. The Participating Brands are not sponsors or administrators of the Promotion.
2. Eligibility
The Promotion is open to legal residents of the 50 United States and the District of Columbia who are 18 years of age or older at the time of entry.
Employees, officers, directors, representatives, and agents of QUAY, the Participating Brands, Instagram, and each of their respective parent companies, subsidiaries, affiliates, advertising and promotion agencies, and immediate family or household members are not eligible to participate.
Void where prohibited or restricted by law.
3. Promotion Period
The Promotion begins on August 20, 2026 at 12:00 a.m. Pacific Time and ends on August 26, 2026 at 11:59 p.m. Pacific Time (the “Entry Period”).
All entries must be received during the Entry Period. Sponsor's computer is the official timekeeping device for the Promotion.
4. How to Enter
During the Entry Period, eligible entrants may enter through Instagram by completing all of the following:
1. Follow @quayaustralia and the official Instagram accounts of all Participating Brands identified in the official giveaway post;
2. Like the official QUAY Back to School Giveaway post; and
3. Comment on the giveaway post and tag three (3) friends.
Completing all three actions constitutes one (1) entry.
Entrants may receive one (1) additional bonus entry by sharing the official giveaway post to their Instagram Story during the Entry Period.
A maximum of two (2) entries per person is permitted: one (1) initial entry and one (1) bonus entry.
To qualify for the bonus entry, the entrant must share the official giveaway post to their Instagram Story during the Entry Period. Sponsor may verify the Story share. If the Story share cannot be verified, Sponsor may request reasonable evidence of the share.
Entrants may receive one (1) additional bonus entry by sharing the official giveaway post to their Instagram Story during the Entry Period and tagging @quayaustralia in the Story so that Sponsor receives notification of the share. The Story must be posted during the Entry Period and otherwise comply with these Official Rules. Sponsor must be able to verify the qualifying Story share. A Story share that does not tag @quayaustralia or otherwise cannot be verified by Sponsor will not qualify for a bonus entry.
For entrants with private accounts or where Sponsor is otherwise unable to view the Story, the entrant must send @quayaustralia a direct message via Instagram ("DM") containing a screenshot showing the qualifying Story share during the Entry Period. Sponsor must be able to verify the qualifying Story share for the bonus entry to be awarded.
No purchase, payment, or other consideration is necessary to enter or win.
Any attempt to obtain additional entries through multiple accounts, identities, automated systems, or fraudulent or deceptive methods may result in disqualification.
Entrants may not tag themselves or use misleading or inaccurate tags in connection with the Promotion.
5. Winner Selection and Odds
Three (3) potential winners will be selected in a random drawing from all eligible entries received during the Entry Period.
The random drawing will take place on or about August 27, 2026.
Each eligible entry has an equal chance of being selected. The odds of winning depend on the total number of eligible entries received.
6. Winner Notification
Potential winners will be notified via Instagram Direct Message and/or the contact information provided by the entrant. Each potential winner must respond within forty-eight (48) hours after the notification is sent and may be required to provide Sponsor with his or her full name, email address, mailing address, and/or other information or documentation reasonably necessary to verify eligibility and fulfill the prize.
If a potential winner does not respond within the required time, cannot be contacted, fails to provide any requested information or documentation within the time specified by Sponsor is determined to be ineligible, or otherwise fails to comply with these Official Rules, the prize may be forfeited and an alternate potential winner may be selected from the remaining eligible entries.
Sponsor is not responsible for a potential winner's failure to receive a notification due to spam filters, privacy settings, account restrictions, technical problems, or other circumstances beyond Sponsor's reasonable control.
7. Prize
Three (3) winners will each receive one (1) QUAY Back to School prize package consisting of products provided by QUAY and the Participating Brands.
The Approximate Retail Value (“ARV”) of each prize package is $600 USD.
The total Approximate Retail Value of all three (3) prize packages is $1,800 USD.
Prizes are subject to availability. Sponsor reserves the right, to the extent permitted by law, to substitute a prize or prize component with another prize of equal or greater value if a listed prize becomes unavailable.
Prizes are non-transferable and may not be redeemed for cash, except where required by law or at Sponsor's sole discretion.
8. Taxes
ALL FEDERAL, STATE, AND LOCAL TAXES AND ANY OTHER COSTS OR EXPENSES ASSOCIATED WITH THE ACCEPTANCE OR USE OF A PRIZE THAT ARE NOT EXPRESSLY INCLUDED IN THE PRIZE DESCRIPTION ARE THE SOLE RESPONSIBILITY OF THE WINNER.
Prizes may constitute taxable income to the winner. Winners are responsible for determining and satisfying any applicable tax obligations associated with acceptance of a prize QUAY will comply with any applicable tax reporting requirements, including providing any required tax forms to the winner.
QUAY reserves the right to request tax or other documentation and/or report the prize to the Internal Revenue Service or applicable taxing authorities if required by applicable law or if circumstances change.
If any tax reporting or information return is legally required in connection with a prize, QUAY will be responsible for the applicable tax reporting and providing the required form(s) to the winner, to the extent required by law.
9. Publicity
Except where prohibited by law, acceptance of a prize constitutes permission for Sponsor and the Participating Brands to use the winner's name, Instagram handle, likeness, photograph, voice, statements, and/or city and state of residence for promotional purposes relating to the Promotion without additional compensation or notice.
10. Release and Limitation of Liability
By participating in the Promotion, entrants agree to release and hold harmless QUAY, the Participating Brands, Instagram, and each of their respective parent companies, subsidiaries, affiliates, officers, directors, employees, representatives, agents, advertising and promotion agencies, successors, and assigns (collectively, the “Released Parties”) from and against any and all claims, liabilities, losses, damages, costs, or expenses arising out of or relating to participation in the Promotion or acceptance, possession, use, misuse, or inability to use any prize, to the fullest extent permitted by law.
The Released Parties are not responsible for lost, late, incomplete, inaccurate, delayed, misdirected, corrupted, or otherwise defective entries; technical failures; internet or network interruptions; unauthorized human intervention; or any other circumstances that may interfere with the proper administration of the Promotion.
11. General Conditions
Sponsor reserves the right, to the extent permitted by law, to disqualify any person who tampers with the entry process, violates these Official Rules, provides inaccurate information, attempts to participate through fraudulent or deceptive means, or otherwise acts in a manner that Sponsor determines may compromise the integrity, security, or proper administration of the Promotion.
If the Promotion cannot be conducted as planned due to fraud, technical failures, platform outages or changes, computer viruses, bugs, tampering, unauthorized intervention, errors, or any other cause beyond Sponsor's reasonable control that corrupts or affects the administration, security, fairness, integrity, or proper conduct of the Promotion, Sponsor reserves the right, to the extent permitted by law, to modify, suspend, or terminate the Promotion and, if terminated, to conduct the drawing from among all eligible entries received before such action was taken, or otherwise award the prizes in a manner Sponsor determines to be fair and consistent with these Official Rules and applicable law
Sponsor's decisions concerning the Promotion are final and binding, subject to applicable law.
12. Instagram Disclaimer
This Promotion is in no way sponsored, endorsed, administered by, or associated with Instagram.
By entering the Promotion, each entrant agrees to release Instagram from any and all liability arising out of or relating to the entrant's participation in the Promotion.
Entrants understand that they are providing their information to QUAY and/or the applicable Participating Brand, and not to Instagram.
Instagram is not responsible for the Promotion or its administration.
13. Privacy
Personal information collected in connection with the Promotion will be used for purposes of administering the Promotion, contacting potential winners, fulfilling prizes, complying with legal requirements, and for other purposes disclosed to entrants at the time of collection.
Personal information will be handled in accordance with the applicable privacy policies of QUAY and/or the applicable Participating Brands. To the extent a Participating Brand is responsible for providing or shipping a portion of a prize directly to a winner, QUAY may provide that Participating Brand with the winner's personal information as reasonably necessary to fulfill or deliver the applicable prize. Participating Brands will not receive entrant personal information for independent marketing purposes through the Promotion unless separately disclosed to and authorized by the entrant in accordance with applicable law.

14. Governing Law
The Promotion and these Official Rules are subject to applicable federal, state, and local laws and regulations.
To the extent permitted by law, these Official Rules shall be governed by the laws of the State of California, without regard to its conflict-of-law principles.
